ARTICLE 1 - NATURE OF THE ACTIVITY AND NAME

RASHOMON ESCAPE is a SAS with capital of €11,998.00 registered with the PARIS RCS under number 830 341 228, whose head office is located at 26 rue Breguet (75011) PARIS and carrying out its activity in its establishment at the same address in operating the brand “RASHOMON ESCAPE” (hereinafter “RASHOMON ESCAPE”).

The following general terms and conditions of sale apply to any contract for the provision (hereinafter “the contract”) of a game room between RASHOMON ESCAPE and its customers (hereinafter “users”) that they have reserved personally , whether they are part of the team of the person who made the reservation (hereinafter “the buyer”), or whether they have entered even for a short time in one or more rooms. These conditions also apply regardless of the means of reservation.

The escape game service (hereinafter “the game session”) is made available to users in a dedicated space (hereinafter “the room(s”)) within the premises of RASHOMON ESCAPE.

RASHOMON ESCAPE reserves the right to modify or have modified all or part of these general terms and conditions of sale as well as the content of its website, at its sole discretion, at any time and without prior notice.

ARTICLE 2 - ACCESS TO FACILITIES

Access to the rooms is reserved for people aged 9 or over. Children can access the rooms from 9 years old, provided they are accompanied by an adult. RASHOMON ESCAPE reserves the right to request identification to verify the age of users. Access to the premises is strictly prohibited for animals and children under 9 years old. Babies and infants are not accepted in the premises or rooms, even accompanied.

People with a visual or hearing impairment can access the rooms if they are part of a group containing at least one person without a disability. People with motor disabilities cannot currently access the rooms.

It is strictly forbidden to enter the rooms with food, drinks, a mobile phone or any device capable of filming or taking photos. Smoking or vaping is strictly prohibited in the rooms and premises. The user undertakes not to bring into the premises and rooms any objects considered to be (1) physical dangers (explosive, flammable, oxidizing, pressurized or liquefied gas, corrosive, etc.), (2) dangerous for health (toxic, corrosive to water, irritant/sensitizer, carcinogen/teratogen).

RASHOMON ESCAPE provides secure boxes to protect users’ personal belongings. They will be asked to drop them off upon their arrival. RASHOMON ESCAPE and its employees cannot be held responsible for any theft occurring on or off its premises.

Regarding clothing to access the rooms, it's important to note that comfortable clothing is recommended, while fragile, delicate, or uncomfortable clothing, as well as suits and high heels, are strongly discouraged. RASHOMON ESCAPE and its employees cannot be held responsible for any material damage or discomfort regarding users' clothing.

RASHOMON ESCAPE also reserves the right to refuse access to its rooms or premises to any user under the influence of alcohol or drugs, as a security measure for said user. Furthermore, users undertake to behave in a respectable manner, to comply with the rules and to cooperate with RASHOMON ESCAPE staff. As such, RASHOMON ESCAPE does not tolerate any form of violence, whether verbal or physical, in the form of harassment or intimidation towards its employees and thus reserves the right to refuse access to the premises to any person whose behavior would be similar to the elements mentioned above. The qualification of the racist/sexist/homophobic or discriminatory nature of the comments made is left to the free assessment of the RASHOMON ESCAPE staff. For all the conditions mentioned above, the access ban does not entitle you to any compensation or reimbursement.

Users are required to arrive at the time indicated on their booking confirmation, in full.

If they arrive early, they may be refused access to the premises before the appointed time.

In the event of a delay, the countdown marking 60 minutes of play in the room may be started before users enter the room.

In the event of a delay of more than 15 minutes, each additional minute of delay will be deducted from the 60-minute countdown.

If late by more than 30 minutes, users may be refused access to the room. For all the conditions mentioned above, the access ban does not entitle you to any compensation or reimbursement.

ARTICLE 3 - USE OF THE ROOMS

Each service is organized for groups of 2 to 6 people (except for the room: THE CRIME, of 2 to 5 players). The service is offered in French or English on request (except for thr room: THE CRIME, playable in French only).

The service includes a two-part briefing: the first part covers security and general game rules, while the second part provides players with the context of their mission for immersion. The game begins following the briefing. The session concludes with a debriefing and a group photo. Please note that any delays by users may affect the quality of the service (see Article 2)."

Access to the rooms is a maximum of 60 minutes, whether users have completed the room puzzles or not. Users are aware that the game session may end before the 60 minute deadline if they manage to solve all the puzzles, without this entitling them to compensation, reimbursement or compensation.

For the purposes of the game, users will be required to manipulate the equipment and installations present in the rooms. Users are required to maintain this equipment and installations (including decorations) in good condition and to use them in accordance with the authorized use. RASHOMON ESCAPE is entitled to charge users and visitors for any damage or degradation of facilities, whether intentional or caused by improper use of room equipment and facilities.

Each player participates in the game at their own risk. RASHOMON ESCAPE or its employees cannot be held responsible in the event of an accident resulting from improper use of objects in the room or by objects in the room. In addition, RASHOMON ESCAPE is not responsible for damages (personal or material) committed by not following the rules described in the safety briefing before the game.

Users undertake to scrupulously respect the rules and instructions of the rooms, whether they are presented orally by the staff during the game briefing, displayed on the site or contractually. They include, but are not limited to:

- do not use physical force in the game.

- do not interact with or touch objects, equipment and installations marked with red tape, red stickers and/or “do not touch” labels.

- do not grab or touch anything above 1m70 (one meter seventy).

- do not unplug and/or manipulate electrical outlets.

- do not unplug and/or manipulate the radiators, fans or air conditioning present in the game for the comfort of users.

- do not unplug and/or manipulate the cameras present for the smooth running of the session and the monitoring of users by RASHOMON ESCAPE staff.

- do not unplug and/or manipulate the lighting fixtures present for the comfort of users.

- do not use verbal, physical or psychological violence on RASHOMON ESCAPE staff when they have to intervene in the rooms.

- do not run in the rooms, for safety reasons.

ARTICLE 4 – RESERVATION

4.1 - RESERVATION AND ACCESS
Access to RASHOMON ESCAPE facilities and services is provided exclusively after reservation on the website www.rashomon-escape.com, with the exception of reservations by professionals (see ARTICLE 7 – COMPANY SERVICES). The reservation is made for a specific day and time, and is only valid for this time slot. Reservations are made within the limit of available places, which are updated in real time on the company's website.

In the event that a customer is unable to book via the website, they may be offered to book at the RASHOMON ESCAPE premises, where they will be asked to accept these general conditions of sale. Both on-site reservations and online reservations require immediate payment; only euros are accepted.

The booking will only be firm and definitive upon the client's receipt of a confirmation email sent by RASHOMON ESCAPE.

A reservation cannot be transferred or resold for commercial purposes. If a reservation is transferred or resold in violation of this section, the holder will be denied access.

If the number of users who show up for the game session is lower than that initially planned when booking, the buyer and/or users cannot claim reimbursement of the price difference.

If the number of users who show up for the game session is greater than that initially planned when booking, the price difference must be paid before participating in the game session, within the limit of 6 users authorized by room (or 5 for "THE CRIME").

RASHOMON ESCAPE reserves the right to refuse any reservation to a user who has not paid for all the services billed to them.

4.2 PAYMENT
RASHOMON ESCAPE accepts the following payments:

- Online by credit card, Connect holiday voucher or transfer for quotes.

- On site, bank card or cash or physical holiday voucher.

5.1 – PRICES

The prices indicated by RASHOMON ESCAPE are in euros, all taxes included, taking into account the VAT applicable on the day of the order, any change in the rate may be passed on to the price of the services.

RASHOMON ESCAPE reserves the right to modify the prices appearing on its website at any time.

In all cases, the service will be invoiced on the basis of the rates in force and mentioned on the site at the time of booking.
Please note that certain discounts, in the form of codes, may apply during promotional operations. If applicable, these reductions can only be applied at the time of booking and are neither retroactive nor cumulative. The reduction code is added by the buyer and cannot therefore give rise to any compensation in case of forgetfulness, or ignorance of the existence of such a discount.

RASHOMON ESCAPE reserves the right to modify the reserved game and transfer players to another room without compensation or reimbursement.

Due to the nature of its activity, RASHOMON ESCAPE will not accept any request for modification of the game session or service as a whole by the client or users.

In the event of cancellation of the game session or service as a whole, no refund or financial compensation will be made by RASHOMON ESCAPE to the client and/or users.

According to article L.221-28 of the Consumer Code: “The right of withdrawal cannot be exercised for contracts [...] For the provision of accommodation services, other than residential accommodation, transport of goods, car rentals, catering or leisure activities which must be provided on a specific date or period”. Neither users nor the customer can therefore exercise their right of withdrawal for the services offered by RASHOMON ESCAPE, with the exception of gift vouchers.

In accordance with article L.121-20-12 of the Consumer Code, the customer has a 14-day right of withdrawal concerning gift vouchers only. To exercise this right of withdrawal, the customer can send his request by email to the address contact@rahomon-escape.com.

As part of a service for an organization, whether it is a non-profit organization, a 1901 law association, a private company or a public structure, another reservation process can be implemented.

The customer or representative of this organization (hereinafter, the “representative”) acknowledges that it is possible to book at the same price as a consumer by respecting the reservation system available on the site www.rahomon-escape. com

However, at the request of the representative, he may receive a quote whose validity will be temporary so as to give the representative time to think. In certain cases, this quote may also make it possible to place an option on the chosen rooms, which will have the effect of making them unavailable for reservation from the site and will grant temporary exclusivity of these rooms to the representative.

VAT to pay even if company located abroad.

By making a reservation, the customer consents to the collection of personal data essential to ensure the proper processing of orders. RASHOMON ESCAPE undertakes never to communicate this information to third parties except in cases provided for by law.

The customer has the right to access, modify, rectify and delete data concerning him (art. 34 of the “Informatique et Libertés” law of January 6, 1978). To exercise this right, you must contact RASHOMON ESCAPE by mail addressed to the head office.

Photos of users may be taken before or after the game session. These photos may be used by RASHOMON ESCAPE to feed its digital communication ((Non-exhaustive examples: Facebook, Twitter, Instagram etc.). These same photos will be sent by email to users within a reasonable time after the game session.

RASHOMON ESCAPE cannot be held responsible for the use that will be made of the photos by users and/or the buyer.

Each room has a video surveillance and listening device allowing RASHOMON ESCAPE staff to monitor the game session and direct users if necessary. This device only contributes to gameplay and does not record gaming sessions in any way.

In order to maintain the confidentiality of the rooms, any sound or video recording and any photography is strictly prohibited. Furthermore, the client undertakes not to reveal the contents or details of the rooms subsequently. Any disclosure, direct or indirect, partial or total, would violate the commercial interests of RASHOMON ESCAPE and these general conditions of sale.

All elements, texts, videos, images, visual supports whatever they may be, present on the site www.rashomon-escape.com or social networks are the exclusive property of RASHOMON ESCAPE. Any reproduction or use without proper written permission is strictly prohibited.
